THE GOOD MOVE ONLINE COACHING and PERSONAL TRAINING TERMS & CONDITIONS

1. THE COACHING SERVICE 

The Online Coaching Service provides personalised fitness and nutrition guidance designed around the Client’s individual goals, lifestyle, training experience and needs. 

Depending on the package selected, coaching may include: 

  • Individualised training programming 

  • Personalised nutrition targets and guidance 

  • Macro/calorie targets where appropriate 

  • Recipe and meal guidance 

  • Weekly or fortnightly check-ins 

  • Progress reviews and feedback 

  • Exercise technique guidance 

  • Mobility and recovery guidance 

  • Access to the coaching platform 

  • Community support 

  • Ongoing communication with the Coach 

The exact services included are determined by the package selected by the Client at the time of purchase. 

 

2. 12-WEEK MINIMUM COMMITMENT 

The Coaching Service has a minimum initial commitment of 12 weeks

By enrolling, the Client agrees to participate in and pay for the full initial 12-week coaching period. 

The 12-week commitment begins on the Client’s agreed coaching start date and ends 12 weeks later. 

The purpose of the minimum commitment is to allow sufficient time to establish habits, implement the personalised training and nutrition approach, monitor progress and make appropriate adjustments. 

The Client acknowledges that meaningful changes in strength, fitness, body composition, nutrition habits and overall wellbeing generally require consistency and time, and that individual results will vary. 


 

Where the Client chooses a payment plan, the payment schedule is a method of paying the agreed 12-week coaching fee and does not change the Client’s minimum 12-week commitment. 

The Client agrees to ensure that all scheduled payments are made on time. 

 

4. CANCELLATION DURING THE INITIAL 12 WEEKS 

The Client may request to end coaching before the initial 12-week period has ended. 

However, unless another arrangement is agreed in writing or the Client has a legal right to cancel or obtain a remedy, the Client remains responsible for the agreed fees for the initial 12-week commitment. 

This means that cancelling participation, ceasing to complete check-ins, stopping communication, or choosing not to use the coaching platform does not automatically end the payment obligation. 

Where appropriate, the Coach may agree to an early termination arrangement at their discretion. 

Nothing in these Terms & Conditions limits or excludes any rights the Client may have under applicable New Zealand consumer law. 

 

5. PAUSING COACHING 

A coaching pause may be requested where the Client is temporarily unable to participate due to circumstances such as: 

  • Significant illness or injury 

  • Pregnancy 

  • Extended travel 

  • Major personal circumstances 

  • Other circumstances agreed upon by the Coach 

Requests to pause should be made in writing as soon as reasonably possible. 

Any approved pause will be discussed and agreed between the Coach and Client, including the length of the pause and how the coaching end date will be affected. 

A pause is not automatically available simply because the Client has become busy, lost motivation or is temporarily not following the program. 

 

6. AFTER THE INITIAL 12 WEEKS 

At the completion of the initial 12-week commitment, coaching will: 

End automatically unless the Client chooses to continue 

OR 

Continue on a rolling weekly basis unless cancelled in accordance with the cancellation terms below. 

The Client may cancel ongoing coaching by providing 14 days written notice. 

 

7. CLIENT RESPONSIBILITIES 

The Client understands that coaching works best when they actively participate in the process. 

The Client agrees to: 

  • Complete their training to the best of their ability 

  • Follow the agreed nutrition guidance as appropriate 

  • Complete check-ins honestly and accurately 

  • Communicate relevant changes in circumstances 

  • Provide accurate information about their health, injuries and exercise history 

  • Communicate any concerns or difficulties with the Coach 

  • Seek appropriate medical advice where necessary 

  • Follow professional medical advice where applicable 

The Coach cannot provide effective guidance based on information that is inaccurate, incomplete or intentionally withheld. 

 

8. NUTRITION COACHING 

Nutrition guidance is provided for general health, fitness and lifestyle purposes and is tailored to the information provided by the Client. 

Nutrition coaching may include calorie and macro targets, meal structure, food education, recipes, meal ideas and general nutritional guidance. 

The Coach does not diagnose, treat or manage medical conditions through nutrition coaching. 

Where a Client has a medical condition, diagnosed eating disorder, significant history of disordered eating, food allergy, complex dietary requirement or other health concern requiring clinical nutrition advice, the Coach may recommend that the Client consult an appropriately qualified health professional, such as a registered dietitian or medical practitioner. 

The Client remains responsible for informing the Coach of any relevant health conditions, medications, allergies or dietary restrictions. 

 

9. NO GUARANTEE OF RESULTS 

The Coach does not guarantee a particular amount of weight loss, muscle gain, body composition change, strength increase or other physical outcome. 

Results vary between individuals and are influenced by factors including genetics, consistency, sleep, stress, nutrition, training, lifestyle and health. 

The Coach will provide personalised guidance, education, programming and support, but the Client is responsible for their participation and implementation. 

 

10. HEALTH & EXERCISE 

The Client understands that physical exercise carries inherent risks. 

The Client agrees to inform the Coach of any injuries, medical conditions, pain, pregnancy, medication changes or other circumstances that may affect their ability to exercise safely. 

The Client should seek medical clearance where appropriate before commencing or changing their exercise program. 

If the Client experiences pain, dizziness, shortness of breath, chest pain or other concerning symptoms during exercise, they should stop exercising and seek appropriate medical attention. 

 

11. CHECK-INS & COMMUNICATION 

The Client is responsible for completing check-ins within the agreed timeframe. 

If a Client does not complete a check-in, the Coach may be unable to provide the planned feedback or adjustments for that period. 

Missed check-ins do not automatically extend the coaching period or reduce the agreed coaching fee. 

The Coach will respond to messages within 6 business hours Monday to Friday, excluding public holidays unless otherwise communicated. 

The coaching service is not an emergency or medical service. 

 

12. COACHING PLATFORM & CONTENT 

Any training programs, nutrition resources, recipes, educational material, videos, documents or other resources provided as part of the coaching service are for the Client’s personal use only. 

The Client must not reproduce, distribute, sell, share or commercially use the Coach’s programs, resources or materials without written permission. 

 

13. PRIVACY & PERSONAL INFORMATION 

The Coach may collect personal information reasonably required to provide the coaching service. 

This may include information relating to the Client’s goals, training, nutrition, progress and general health information provided for coaching purposes. 

The Coach will handle personal information in accordance with applicable New Zealand privacy requirements. 

The Client agrees that information provided to the Coach must be accurate and current. 

 

14. COACH TERMINATION 

The Coach may terminate the coaching relationship where there has been: 

  • Abusive, threatening or inappropriate behaviour 

  • Repeated failure to make agreed payments 

  • Deliberate provision of materially false information 

  • Behaviour that creates a safety concern 

  • Other serious breach of these Terms & Conditions 

Where coaching is terminated by the Coach, the Client will be informed of the reason where appropriate and any applicable refund or payment consequences will be handled in accordance with these Terms & Conditions and applicable law. 

 

15. CHANGES TO COACHING SERVICES 

The Coach may make reasonable changes to the delivery of the coaching service where necessary, provided that the core service purchased by the Client continues to be provided. 

Any significant changes affecting the Client’s agreement will be communicated appropriately. 

 

16. CONSUMER RIGHTS 

Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights or remedies that the Client has under applicable New Zealand law, including the Consumer Guarantees Act 1993 and Fair Trading Act 1986. 

Where a service does not meet applicable legal guarantees, the Client may have rights to a remedy depending on the circumstances.
